Barns rett til medvirkning i den norske barnevernloven og medvirkningsforskriften- En kvalitativ innholdsanalyse av høringsinnspill til forskrift om barns rett til medvirkning

Sammendrag

Den forrige norske barnevernvernsloven var gjeldende i 30 år, før vi 01.01 2023 fikk en ny barnevernslov. Den hadde som et overordnet mål å sikre bedre rettsikkerhet for både barn og foreldre. En av de største endringene i den nye barnevernloven, er det forsterkede fokuset på barns rett til medvirkning. Det er det denne masteroppgaven skal handle om, å se endringene som har skjedd innenfor medvirkningsfeltet i barnevernloven, og tilhørende forskrift. Det fører med seg følgende problemstilling, som skal forsøke å bli besvart i denne oppgaven: Hva kjennetegner diskusjonen rundt endringer i regelverket knyttet til medvirkning, slik det kommer til syne i høringsinnspillene til høringsutkastet til forskrift om barns medvirkning i barnevernet? Som en presisering av den overordnende problemstillingen skal særlig disse to underspørsmålene undersøkes i løpet av oppgaven. Hvilke ulike posisjoner finnes i denne diskusjonen knyttet til perspektiver på medvirkning? Hvilke vurderinger gjøres av endringsforslagene knyttet til perspektiver på barnas deltagelsesprosess i forbindelse med den nye medvirkningforskiften?

Studien har et kvalitativt forskningsopplegg, bestående av en kvalitativ dokumentanalyse. Materialet som brukes i oppgaven er høringsinnspill hentet fra høringen forskrift om barns medvirkning i barnevernet datert 24.06.22. Studien den har vist at innspillene bærer preg av å anerkjenne barnas deltagelsprosess, og at de er en reell aktør som skal kunne bli hørt, og at det å få ut all implementering i praksis, det er en langvarig prosess som det kreves videre utarbeidelse, og arbeid med. Videre betyr dette, at man ved den nye barnevernloven, og den tilhørende medvirkningsforskriften virker å være et godt steg på veien i å øke barnas rett til medvirkning, men at det enda er noen momenter som kan forbedres med tanke på å øke den reelle medvirkningen i praksis.

Abstract

The previous Norwegian Child Protection Act was valid for 30 years, before we got a new Child Protection Act in 01.01 2023. It had as an overarching goal to ensure better rule of law for both children and parents. One of the biggest changes in the new Child Protection Act is the increased focus on children's right to participation. That is what this master's thesis will be about, to see the changes that have taken place within the field of participation in the Child Protection Act, and related regulations. This brings with it the following problem, which will be attempted to be answered in this thesis: What characterizes the discussion around changes in the regulations related to participation, as it appears in the consultation input for the consultation draft for regulations on children's participation in child protection? As a clarification of the overarching problem, these two sub-questions in particular are to be investigated during the course of the thesis. What different positions exist in this discussion related to perspectives on participation? What assessments are made of the proposed amendments relating to perspectives on the children's participation process in connection with the new participation regulation? The study has a qualitative research plan, consisting of a qualitative document analysis. The material used in the thesis is consultation note taken from the consultation regulation on children's participation in child protection dated 24.06.22. The study has shown that the input bears the stamp of recognizing the children's participation process, and that they are a real actor who should be able to be heard, and that getting all implementation into practice is a long-term process that requires further preparation, and work with. Furthermore, this means that the new Child Protection Act and the associated participation regulations appear to be a good step on the way to increasing children's right to participation, but that there are still some elements that can be improved with a view to increasing real participation in practice.
